1. Definitions
"UmrahFirst" — UmrahFirst.co.uk, the technology platform.
"Platform" — the website, API, and related services operated by UmrahFirst.
"Traveller" — an individual using the Platform to find Umrah packages.
"Agent" — a travel agent or travel company registered on the Platform.
"Services" — the travel packages, quotes, and related services offered by Agents.
"We/Us/Our" — UmrahFirst.
2. About UmrahFirst — Important Disclaimer
UmrahFirst is a technology platform, not a travel agency. We do not sell, resell, provide, or fulfil any travel services. Our role is strictly limited to operating a digital marketplace that connects Travellers with independent third-party travel Agents.
All travel packages, quotes, bookings, and services advertised or offered through the Platform are provided solely by the independent travel Agents listed on the Platform, not by UmrahFirst. Any contract for travel services is formed directly between the Traveller and the Agent, and UmrahFirst is not a party to that contract.
We strongly recommend that Travellers independently verify an Agent's ATOL status at caa.co.uk before making any payment.
3. For Travellers
By submitting an enquiry on UmrahFirst, you agree that:
- Your enquiry details (name, email, phone, travel preferences) will be shared with verified Agents on the Platform who may contact you directly with quotes.
- UmrahFirst does not guarantee that any Agent will respond to your enquiry or that you will receive a specific number of quotes.
- UmrahFirst does not endorse, recommend, or vouch for any individual Agent listed on the Platform. Agent profiles and verification badges indicate that we have verified certain credentials, but this does not constitute a guarantee of service quality.
- You are responsible for conducting your own due diligence on any Agent before entering into a contract or making payment.
- Any dispute regarding a travel service must be resolved directly with the Agent who provided it.
4. For Agents
By registering on UmrahFirst, you agree that:
- All information provided during registration is accurate, truthful, and up to date.
- You hold a valid ATOL licence (if applicable) and will notify UmrahFirst immediately if your ATOL status changes.
- You are solely responsible for the accuracy and completeness of all package listings, prices, availability, and information you post on the Platform.
- You are solely responsible for fulfilling all bookings made through the Platform and for the quality of all travel services you provide.
- You will maintain appropriate travel insurance and professional indemnity insurance.
- UmrahFirst reserves the right to verify your credentials with official registers at any time.
- UmrahFirst reserves the right to suspend or terminate your account at any time, with or without notice, if we believe you have provided false information, violated these terms, or received consistent negative feedback from Travellers.
Agents may be charged subscription fees as agreed during registration. Subscription fees are non-refundable except where required by UK consumer law. UmrahFirst does not charge commission on bookings — Agents retain 100% of revenue from their bookings.
5. Limitation of Liability
To the fullest extent permitted by UK law:
- UmrahFirst provides the Platform "as is" and makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Platform.
- UmrahFirst shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of or inability to use the Platform.
- UmrahFirst shall not be liable for any loss, damage, injury, or death resulting from travel services booked through an Agent found on the Platform.
- UmrahFirst shall not be liable for any financial loss resulting from payments made to Agents, including but not limited to cancelled bookings, non-delivery of services, or fraudulent activity by Agents.
- UmrahFirst's total liability for any claim arising from use of the Platform shall not exceed the total subscription fees paid by that Agent in the preceding 12 months, or £100 for Travellers.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by UK law.
6. Agent Verification Disclaimer
UmrahFirst conducts verification checks on Agents, including ATOL verification via the UK Civil Aviation Authority and Companies House checks. However:
- Verification does not guarantee the quality, safety, or legitimacy of any Agent's services.
- Verification status may change — Travellers should re-verify ATOL status independently at the time of booking.
- UmrahFirst is not liable for any misrepresentation by an Agent regarding their credentials.
7. Intellectual Property
All content on the UmrahFirst Platform, including the name, logo, design, and underlying code, is owned by or licensed to UmrahFirst. Agents grant UmrahFirst a non-exclusive, worldwide, royalty-free licence to display their package listings, company name, logo, and related content on the Platform for the duration of their account.
8. User Conduct
You agree not to misuse the Platform, including but not limited to: posting false or misleading information, harassing other users, scraping or automating data collection without permission, or attempting to circumvent security measures.
9. Indemnification
Agents agree to indemnify and hold UmrahFirst harmless from any claims, damages, losses, or expenses (including legal fees) arising from: their breach of these terms, their provision of travel services, or any misrepresentation made by them on the Platform.
10. Termination
UmrahFirst may suspend or terminate access to the Platform at any time for violation of these terms. Agents may terminate their account by contacting us. Upon termination, Agent listings will be removed from the Platform within 48 hours.
11. Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the English courts.
12. Changes to Terms
We may modify these terms at any time. Material changes will be communicated to registered Agents via email and to Travellers via a notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the modified terms.
